Delhi Police now filing criminal cases for hazardous wrong-side driving incidents

Delhi Police has started registering criminal cases against vehicle owners for driving on the wrong side of the road, making the national capital the first Union Territory to adopt this approach. So far, three FIRs have been filed under the new enforcement practice, according to media reports.

When criminal charges will apply

Officials clarified that criminal action will not be invoked in all instances of wrong-side driving. According to statements cited by Indian Express, FIRs will be registered only when the traffic police observe behaviour that puts others at risk – such as driving against traffic during heavy flow or creating a hazardous situation. In other cases, penalties will continue to be imposed under existing traffic rules without criminal proceedings.

Fines and legal provisions

Driving against the designated flow of traffic currently carries penalties of up to Rs. 5000 under traffic regulations. However, when an FIR is lodged under Section 281 of the Bharatiya Nyay Sanhita (BNS) 2023, offenders may face additional consequences, including a maximum jail term of six months and a fine of Rs. 1000. The involved vehicle may also be impounded.

Police confirmed that the cases registered so far are bailable and motorists arrested under these provisions were released on bail.

Wrong-side driving has been identified as a recurring safety issue in Delhi, contributing to collisions and traffic disruptions. The decision to file criminal cases in high-risk situations indicates an escalation in enforcement intended to deter such behaviour.
